WHAT ARE RIGHTS MANAGED IMAGES
Rights-Managed images are images that must be licensed for a specific use. The fee for these images is calculated from several factors including size, placement, duration of use and geographical location. Rights-Managed images are licensed for a specific use and cannot be used for any purpose other than what is specified when licensing the image. If you are looking for a unique image, then you should look for Rights-Managed images. With Rights-managed images you can be informed of any current or past use of the image. You can also secure exclusive rights for an agreed time period at an extra cost.
Oceanic Research & Publishing Ltd grants the rights to use an image(s) for commercial purposes as Rights Managed image(s). We offer image licensing on a simplified basis where only the usage and / or duration of use are taken into account.

WHAT ARE ROYALTY FREE IMAGES
Royalty Free images are NOT PROTECTED by ANY form of rights-protection, ANYONE, including your competitors, may be using the same image as you are, at the same time, for the same purpose. If you require any form of rights-protection you should license a Rights-Managed image.
Oceanic Research & Publishing Ltd does not grant the rights to use any image(s) licensed as Royalty free image(s).

ARE THERE ANY RESTRICTIONS ON MY USE OF THE OCEANIC RESEARCH & PUBLISHING IMAGES THAT I BUY?
Yes. Oceanic Research & Publishing images are images that are licensed for a specific use only and for a one time use only unless otherwise specified, except for images that are for website use, in which case the fee payable is for a one year use. (Rights Managed Images)
After you pay Oceanic Research & Publishing Ltd for the use of a Rights Managed image, Oceanic Research & Publishing Ltd grants you, or your employer if you are licensing on behalf of your employer or your client, a NON EXCLUSIVE, NON -SUBLICENSABLE, NON-TRANSFERABLE right to use the image(s) subject to the terms and conditions of the licensing agreement. We do not allow the redistribution of our photos, or allow the use of our photos within products that are mass distributed in any type of archive format. Please read our LICENSE AGREEMENT.
Rights-Managed images are licensed for a specific use and cannot be used for any purpose other than what is specified when licensing the image, nor can these images be used in re-releases, subsequent or collective editionswithout obtaining prior permission from Oceanic Research & Publishing Ltd and paying for the additional use fees.

ELECTRONIC REPRODUCTION OF IMAGES AND USE OF IMAGES ON WORLD WIDE WEB (INTERNET)
Unless specifically stated within the License agreement, the reproduction rights granted, do not include any form of electronic reproduction of the image, nor the use of the image(s) on the World Wide Web (Internet, website) in any form or size. Images that are required for use on the World Wide Web (Internet) must be licensed separately.
For any image(s) that have been granted reproduction rights for use on the World Wide Web, you shall take all reasonable steps to protect the image(s) from being copied or downloaded. Furthermore, the image(s) shall havefull credit & copyright information clearly visible on the image used and not below or beside the image. Images for use on the World Wide Web shall not exceed a size of 72 dpi and 1000 pixels at the largest side.

UNAUTHORISED USAGE
In the event you utilize an image other than for the usage indicated on our Invoice / License agreement, without first obtaining prior permission andpaying for the additional use fees, Oceanic Research & Publishing Ltd retains the right to take legal action against you for copyright infringement. We will however agree not to take legal action, if you agree to pay the copyright infringement fee, equal to five times the normal price we would have charged for such unauthorized use, within seven days of our billing such a fee.
If you fail to make such payment within the time allowed, this copyright infringementfee shall be void and we shall have the right to take legal action for copyright infringement and/or breach of contract, for which we will shall seek all damages and remedies available, including Lawyers fees and all associated costs.

COPYRIGHT & OWNERSHIP
Ownership of the images always remains that of Oceanic Research & Publishing Ltd and / or the photographer who made the image(s). All images are copyrighted. Oceanic Research & Publishing Ltd and the photographer(s) who made the image(s) own ALL the rights to the image(s). All rights not specifically granted to you by the usage license / invoice are reserved. When you pay for an image(s) you DO NOT BECOME THE OWNER of the image(s). We are NOT selling these images outright to you, you are purchasing rights to use the image(s) (Licensing) subject to the terms & conditions of the License agreement. Full credit & copyright information must remain with the image(s) and be clearly visible alongside the image once used.

IMAGE QUALITY ON WEBSITE All images displayed here on the Oceanic Research Image Library are in very low resolution of 640 pixels and have a watermark imposed on them to prevent theft. Sometimes it is not easy to see or judge the quality of an image at this size. Should you require to view a larger image in order to make your buying decision, please email us.
We will send to you by E-mail an image sized 1000 pixels, this will however retain our watermark.

HOW TO PURCHASE AN IMAGE
1) Register your details as a user
2) View the image you require
3) Select the usage and corresponding price, that the image is required for from the drop down list below the image
4) Add image to your shopping cart
5) Go to checkout and view your shopping cart
6) Enter your user name and password
7) Continue to payment section

HOW LONG DOES IT TAKE TO PROCESS AN ORDER
Normally this will take between 24 and 60 hours. Please check the Image Library home page, right hand side "LATEST NEWS" to check if we are open or closed or away on assignment.
Once your order is received we will send your Invoice and Licensing Agreement, together with a medium resolution image of 2000 pixels, compressed to JPG format, for your immediate use, whilst the high resolution image(s) are processed and sent to you by postal service.
Images licensed for use on the World Wide Web are supplied as low resolution, max size 1000 pixels at 72 dpi, and are delivered by E-mail.

IMAGE DELIVERY
Once your order is completed and we have received payment, the image or images will be sent to you on disc (CD or DVD) by postal service.
Unless you have requested a specific image size, the image(s) supplied are Very High Resolution; 400 dpi - 7000 pixels - 30 x 45 cm size, uncompressed in PC-TIFF format and are in 24 bit RGB colour mode (8 bits per channel) The disc supplied will also contain smaller sized images for easy viewing.
In addition to this we will E-mail you a medium resolution image of 2000 pixels, compressed to JPG format, together with your Invoice and Licensing Agreement.
Images licensed for use on the World Wide Web are supplied as low resolution, max size 1000 pixels at 72 dpi, and are delivered by E-mail.
Watermarks are removed for delivery.

LARGER IMAGES
Should you require larger sized images please E-mail us prior to completing your order to check for availability. Many of the newer digital images are available up to a size of 10,000 pixels

RGB vs CMYK
All our images are supplied in RGB colour mode. RGB stands for Red, Green, & Blue, which are the 3 colors used to display images on your computer screen and for general printing purposes. However, when preparing files for commercial printing all images and artwork must be converted to CMYK colour mode (Cyan, Magenta, Yellow, and Black) in order to make color separations and film for 4 colour offset printing. You can convert an RGB file to CMYK in Photoshop or Photo-Paint, however, converting RGB files to CMYK can alter the color in an undesirable way and will require some time to retouch the colours. This process will normally be undertaken by your printing company.

MACINTOSH USERS
Images are usually saved in PC-TIFF format, should you require the image to be saved in MAC format please advise us prior to order.

ARE JPG IMAGES OF THE SAME QUALITY AS TIFF IMAGES?
Yes they are. However you should be aware that when using JPG images no degradation is noticeable after a single compression / decompression cycle, but that further compressions to and from the JPG format will begin to degrade the image to a point where it will become unusable. To retain the maximum quality, JPG images such as those received by E-mail should be opened and resaved as Tiff format.

WHY ARE DOWNLOADS NOT AVAILABLE ?
This is a technical problem related to server space. In order to be able to allow downloads of an image, it requires that an image be uploaded and stored on our website in various different sizes, which is simply not possible when selling images that are up to 95 mb in size. It is also a security issue, in that this requires images to be stored on the website without watermarks.

WHAT IS A MODEL RELEASE ? A model release is a release signed by the person(s) shown in an image. In the release the person depicted in the image gives consent for this image to be used for commercial purposes - including publishingand advertising, within the terms and conditions of the Licensing agreement.

WHAT IS A PROPERTY RELEASE ? A property release is a release signed by the owner(s) of the property shown in an image. In the release, the owner gives consent for the image depicting his or her property to be used for commercial purposes - including advertising, publishing, promotion, etc.

WHY SHOULD I OBTAIN A MODEL RELEASE ? If a model release exists, then it is held by Oceanic Research & Publishing Ltd, and we will send this to you upon request. The reason for obtaining this release is to have evidence, in-writing for your files of a model's permission to use the image (within the terms and conditions of the license agreement). There are no special rights or privileges associated with obtaining a copy of the model release. Note: The releases available are scans of the actual original release signed by the model or the model¡¯s guardian in the case of a minor. To avoid invasion of privacy, personal details are blacked out from the model releases sent out.

CAN I SUBMIT PHOTOS FOR SALE ? Right now the only photos that we sell are the ones taken by Oceanic research & Publishing. In the future we may consider this.

DO YOU OFFER REFUNDS ? Oceanic research & Publishing Ltd offers refunds on digital images that have not been delivered. If you require a refund on your purchase, please contact us and we will refund your purchase. We will refund the purchase of a digital image up until the delivery of the product. Once the product is delivered, we cannot issue a refund. The reason for this policy is that owing to the nature of a digital image(s), there is no way for this product to be returned, nor is it possible to verify that a digital image has not been copied prior to requesting a refund. Digital images are provided as seen on our website and in addition to this we offer to supply, by email, low resolution (watermarked images) for evaluation purposes. Oceanic Research & Publishing Ltd gives no guarantee of merchantability, fitness for any particular purpose, non-infringement, quality of image, or compatibility with any computer hardware or other equipment, operating system or software program. Oceanic Research & Publishing Ltd sole responsibility will be to provide you with another copy of the image(s) should the product arrived damaged or be faulty. On a rare occasion we will make exceptions on a case by case basis.
